Terms of Use

1. Acceptance of Terms

By accessing or using MatchWatch (the “Service”), you agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree, you must not use the Service.

2. Acknowledgment

You acknowledge that this agreement is between you and Floki Systems for Artificial Intelligence Software Systems (Developers of MatchWatch, trade name Floki Systems), not Apple or Google Play. Floki Systems is solely responsible for the Service and its content.

3. Scope of License

Floki Systems grants you a non-transferable, non-exclusive license to use the Service on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.

4. Maintenance and Support

Floki Systems is solely responsible for providing maintenance and support services for the Service. Apple and Google has no obligation to furnish any maintenance or support services.

5. Warranty Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind. Floki Systems disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Apple is not responsible for any warranties regarding the Service.

6. Product Claims

Floki Systems are responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including but not limited to:

• Product liability claims;
• Any claim that the Service fails to conform to any applicable legal or regulatory requirement;
• Claims arising under consumer protection, privacy, or similar legislation.

7. Intellectual Property Rights

In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party’s intellectual property rights, Floki Systems, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

8. Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo or has been designated by the U.S. Government as a “terrorist supporting” country;
• You are not listed on any U.S. Government list of prohibited or restricted parties.

9. Account Registration

You must be at least 18 years old to create an account. You agree to provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

10. User Conduct

You agree not to:

• Violate any local, national, or international laws.
• Post content that is defamatory, harassing, obscene, or otherwise offensive.
• Impersonate another person or entity.
• Use the Service for any unauthorized commercial purpose.
• Engage in any form of automated data collection or scraping.

12. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Service.

13. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this agreement, and upon your acceptance of the terms and conditions of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.

14. User Content

You retain ownership of any content you post on MatchWatch. By posting, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content to operate and improve the Service.

15. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use your information. It can be accessed through This Link.

16. Limitation of Liability

To the maximum extent permitted by law, Floki Systems and its affiliates will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the app or email. Continued use after changes constitutes acceptance of the updated Terms.
